Withdraw the "Bad Contract"! End Discrimination! Expand the Joint Struggle of Korean and Migrant Workers!

On July 5, a National Joint Rally of Migrant Workers was held in front of the main gate of HD Hyundai Heavy Industries in Ulsan under the slogans: "Withdraw the Bad Contract! Cancel Wage Cuts! End Discriminatory Treatment!"

The rally brought together the Korean Confederation of Trade Unions (KCTU), the Korean Metal Workers' Union (KMWU), the Ulsan Migrants' Center, and numerous labor, migrant, human rights, and civil society organizations. Korean workers, migrant workers, and solidarity activists from across the country participated to condemn HD Hyundai Heavy Industries' discrimination and exploitation and demand full rights for migrant workers.

The rally demonstrated migrant workers standing proudly as the leading force of the struggle, showing genuine class unity beyond nationality and language. Workers from Sri Lanka, Vietnam, Nepal, Indonesia, Myanmar, Bangladesh, Uzbekistan, Thailand, the Philippines, and many other countries marched together carrying their national flags while chanting: "Withdraw the Bad Contract!", "Cancel Wage Cuts!", "End Discrimination!" and "Workers Are One!". Although they spoke different languages, they shared one determination and one struggle.

The rally began with a labour ceremony followed by a video documenting the struggle of migrant workers at HD Hyundai Heavy Industries. Participants looked back on months of continuous resistance and confirmed that this was not a one-day protest but a new stage in an expanding workplace struggle.

Representatives of the KCTU and KMWU stressed in their opening speeches that the discrimination at HD Hyundai Heavy Industries is not simply a problem of one workplace but a structural feature of Korean capitalism, which exploits migrant workers as a source of cheap labour. They emphasized that the struggle of migrant workers is inseparable from the struggle of all workers.

The cultural performances, dances, and collective chants became more than entertainment – they created a sense of unity among workers of many different nationalities. Singing and chanting together, participants expressed international solidarity and workers' fraternity.

Solidarity speakers strongly condemned the reality that workers performing the same labour under the same conditions receive different wages and working conditions simply because of their nationality. They exposed how the company threatened migrant workers by saying that anyone refusing to sign the contract would lose overtime work, weekend work, and even contract renewal. Such contracts, imposed under the threat of visa insecurity and deportation, cannot be considered free agreements.

Speakers also pointed out that many migrant workers arrive in Korea burdened with enormous recruitment fees and debts, only to face wage discrimination, job insecurity, and harsh working conditions after arrival. This double and triple exploitation is not merely the fault of individual companies, but the result of South Korean capitalism's migrant labour policy combined with corporations' pursuit of profit.

Oh Se-il, president of the in-house subcontractors' branch of the KMWU HD Hyundai Heavy Industries Union, revealed that the company forced migrant workers to sign contracts containing wage cuts and discriminatory performance-based pay without sufficient explanation. Managers and supervisors threatened workers that refusing to sign would result in losing overtime, special shifts, and contract renewal, exploiting workers' fear of being forced to return to their home countries.

Although public criticism has grown, the company has continued its pressure by presenting revised contracts translated into several languages while demanding signatures once again. The subcontractors' branch declared that it would continue standing together with migrant workers and stressed that only the collective power of trade union organization can defeat the employers.

The Voices of Migrant Workers Became the Heart of the Rally

Charitha, representing Sri Lankan workers, declared: "The company is still forcing us to accept the bad contract. We will never give up until it is completely withdrawn." He emphasized that trade union organization is essential for victory and called upon workers from Sri Lanka, Vietnam, Nepal, Thailand, Indonesia, and every other country to join the KMWU together. During the rally, many migrant workers actually filled out union membership applications on the spot.

A representative of the Vietnamese workers testified about the harsh reality faced by migrant workers at HD Hyundai Heavy Industries. "We came to Korea dreaming of the Korean Dream, but instead we found discrimination and exploitation." He described dangerous working conditions inside enclosed ships, repeated industrial accidents, the lack of proper medical treatment, annual leave deductions for health examinations, unpaid interpreting work, deductions for protective equipment and meals, and discrimination in bonuses.

He also condemned the company's practice of paying employment insurance while falsely reporting workers as voluntary resignations at the end of their contracts, thereby preventing them from receiving unemployment benefits. He criticized the discriminatory bonus system for encouraging competition among workers instead of solidarity. "We did not come to Korea to beg. We came as workers who sustain Korea's shipbuilding industry. Equal work must mean equal rights."

Rashed, General Secretary of the Migrants' Trade Union (MTU), sharply criticized the reality confronting migrant workers in South Korea. He explained that many E-7-3 visa workers borrow enormous sums of money before coming to Korea, only to experience wage cuts, restrictions on visa renewal, restrictions on changing workplaces, and widespread discrimination. He declared: "Just because we come from developing countries does not mean our lives are cheap. We came here to work – not to sacrifice our lives." He insisted that workers' value should never be measured by nationality but by their labour and their human dignity.

The rally concluded with a march from the main gate of HD Hyundai Heavy Industries. Trade union flags and the national flags of many countries waved side by side as participants chanted the same slogans in many different languages, reaffirming one simple truth:

Workers are One

This joint action began with the courageous decision of a group of migrant workers who firmly refused to accept the company's "Bad Contract." Their brave first step must never be allowed to end in isolation or defeat.

Fortunately, with the support of the HD Hyundai Heavy Industries Union and the Korean Metal Workers' Union, the subcontractors' branch pledged to organize migrant workers into the union and continue supporting their struggle. Many migrant workers completed union membership applications during the rally.

The slogan "Workers Are One" must become more than words – it must become reality through the practical solidarity of Korean workers. Organized Korean workers must ensure that migrant workers do not fight alone. Moreover, the discrimination and exploitation of migrant workers is not simply a problem at one workplace. Beginning with this joint action, the struggle must grow into a nationwide movement.

The Workers' Revolutionary Party (Preparatory Group) will continue to stand with the just struggle of migrant workers at HD Hyundai Heavy Industries and fight to organize all migrant workers into trade unions while expanding joint strikes and united struggles.

'나쁜 계약' 철회 · 차별 철폐! 한국 정주 · 이주노동자 공동투쟁 확대 결의

7월 5일 울산 HD현대중공업 정문 앞에서는 'HD현대중공업 이주노동자 나쁜 계약 철회! 임금삭감 철회! 차별처우 중단! 전국 이주노동자 공동행동대회'가 개최됐다. 이번 공동행동에는 민주노총과 금속노조, 울산이주민센터를 비롯한 노동·이주·인권·시민사회단체들이 함께했으며, 전국 각지에서 모인 한국인 노동자와 이주노동자, 연대단체 회원들이 참가해 HD현대중공업의 차별과 착취를 규탄하고 이주노동자의 권리 보장을 촉구했다.

이날 집회는 이주노동자들이 투쟁 주체로 우뚝 서서 국적과 언어를 뛰어넘어 노동자들의 계급적 단결을 보여준 자리였다. 스리랑카, 베트남, 네팔, 인도네시아, 미얀마, 방글라데시, 우즈베키스탄, 태국, 필리핀 등 여러 나라 출신 노동자들이 각국의 국기를 들고 함께 행진하며 "나쁜 계약 철회", "임금삭감 철회", "차별처우 중단", "노동자는 하나다"를 외쳤다. 서로 사용하는 언어는 달랐지만, 노동자들의 요구와 결의는 하나였다.

집회는 노동의례와 HD현대중공업 이주노동자 투쟁 경과 영상 상영으로 시작됐다. 참가자들은 지난 수개월 동안 이어져 온 이주노동자들의 투쟁을 되돌아보며 이번 공동행동이 하루짜리 집회가 아니라 지속적으로 확대돼 온 현장 투쟁의 새로운 발전임을 확인했다.

이어 민주노총과 금속노조는 대회사를 통해 HD현대중공업에서 벌어지고 있는 차별은 특정 사업장의 문제가 아니라 한국 자본주의가 이주노동자를 저임금 노동력으로 활용하는 구조적 문제라고 지적했다. 또한 이주노동자 투쟁은 정주 노동자와 분리된 문제가 아니라 노동자 전체가 함께 해결해야 할 공동의 과제라고 강조했다.

문화공연과 율동, 구호 제창은 단순한 공연을 넘어 서로 다른 국적의 노동자들이 하나의 공동체로 결속하는 시간이었다. 참가자들은 함께 노래를 부르고 구호를 외치며 국제적 연대와 우애를 나누었다.

연대발언에서는 동일한 현장에서 동일한 노동을 하는 노동자들에게 국적을 이유로 다른 임금체계와 노동조건을 적용하는 현실을 강하게 규탄됐다. 발언자들은 회사가 "계약서에 서명하지 않으면 잔업과 특근을 줄 수 없고 재계약도 어렵다"며 이주노동자들을 압박한 사실을 폭로하고, 체류자격을 이용한 강압적 계약은 자유로운 계약이 아니라며 나쁜 계약을 결코 받아들일 수 없다고 말했다

또한 한국 입국 과정에서 거액의 송출비용과 대출을 감당한 이주노동자들이 입국 이후에도 임금 차별과 고용불안, 열악한 노동환경 속에서 이중·삼중의 착취를 당하고 있다는 점도 지적됐다. 이러한 현실은 일부 기업의 문제가 아니라 남한 자본주의의 이주노동 정책과 기업의 이윤 중심 경영이 결합한 결과라는 비판이 이어졌다.

금속노조 현대중공업지부 사내하청지회 오세일 지회장은 연대발언에서 HD현대중공업이 이주노동자들에게 임금삭감과 성과차등임금제가 포함된 계약을 충분한 설명도 없이 강요했다고 폭로했다. 회사는 팀장과 파트장을 동원해 계약서에 서명하지 않으면 잔업과 특근을 주지 않고 계약도 연장하지 않겠다고 협박했으며, 결국 본국으로 돌아가야 할 것이라는 두려움을 이용해 노동자들을 압박했다.

 회사는 비판이 거세지자 다시 각국 언어로 작성한 계약서를 내밀며 재차 서명을 강요하고 있다. 그러나 사내하청지회는 이주노동자들의 투쟁을 끝까지 함께할 것이며, 자본에 맞서기 위해서는 노동조합의 집단적 힘이 반드시 필요하다고 강조했다.

현장 이주노동자들의 발언이 집회의 핵심이 됐다

스리랑카 노동자 대표 차리타 동지는 "회사는 지금도 나쁜 계약을 강요하고 있으며 우리는 계약이 철회될 때까지 결코 포기하지 않을 것"이라고 밝혔다. 그는 "이 투쟁을 승리로 이끌기 위해서는 노동조합이 반드시 필요하다"며 스리랑카 노동자뿐 아니라 베트남, 네팔, 태국, 인도네시아 등 모든 나라 노동자들이 함께 금속노조에 가입해 투쟁할 것을 호소했다. 이날 현장에서는 실제로 여러 이주노동자들이 노동조합 가입 원서를 작성하며 조직 확대에 나섰다.

이어 베트남 노동자 대표는 HD현대중공업 이주노동자들이 겪는 현실을 증언했다. 그는 "코리안 드림을 꿈꾸며 한국에 왔지만 현실은 차별과 착취였다"며, 밀폐된 선박 내부에서의 위험한 작업환경, 반복되는 산업재해, 치료조차 제대로 보장받지 못하는 현실, 건강검진 시간의 연차 공제, 통역노동에 대한 무급노동, 보호장비 비용 공제, 식비 공제, 성과급 차별 등을 구체적으로 폭로했다.

특히 그는 회사가 고용보험을 납부받고도 계약 종료 시 자발적 퇴사로 허위 신고해 실업급여를 받지 못하게 하는 사례와 성과급 차별을 통해 노동자들 사이의 경쟁을 조장하는 현실을 비판했다. "우리는 구걸하러 한국에 온 것이 아니라 한국 조선산업을 지탱하는 노동자"라며 "동일한 노동에는 동일한 권리가 보장돼야 한다"고 강조했다.

이어 이주노조 라셰드 사무국장은 한국의 이주노동자 현실을 강하게 비판했다. 그는 E-7-3 노동자들이 한국에 오기 위해 본국에서 수천만 원의 비용을 부담했지만 임금삭감과 비자 연장 제한, 사업장 변경 제한, 각종 차별 속에서 살아가고 있다고 지적했다.

라셰드 사무국장은 "우리는 개발도상국에서 왔다고 해서 우리의 삶이 값싼 것이 아니다. 우리는 노동하기 위해 왔지 목숨을 바치기 위해 온 것이 아니다."라고 강조하며, 노동자의 가치는 국적이 아니라 노동과 인간의 존엄으로 평가되어야 한다고 역설했다.

집회 마지막에는 참가자 전원이 현대중공업 정문을 출발해 거리행진을 진행했다. 노동조합 깃발과 각국의 국기가 함께 휘날리는 가운데 참가자들은 여러 언어로 같은 구호를 외치며 “노동자는 하나다”라는 당연한 사실을 새삼 확인하는 힘찬 행진이었다.

이번 공동행동 투쟁은 사측의 “나쁜 계약”을 단호하게 거부한 주체적인 일부 이주노동자들의 용기 있는 행동으로 시작되었다. 이들이 힘들게 내딛은 발걸음이 헛걸음이 되게 해선 안된다. 다행이 현대중공업 지부와 금속노조의 지원 속에 사내하청지회에서 이주노동자 조직화 결의를 가지고 노조가입을 통해 투쟁과 지원을 약속했다. 꽤 많은 이주노동자들이 집회현장에서 배부한 노동조합가입원서를 작성했다고 한다. “노동자는 하나다”라는 이번 집회의 슬로건을 말이 아니라 실천으로 보여줘야 하는 과제가 정주노동자들에게 놓여졌다. 이들의 투쟁이 외롭고 힘들지 않게 조직된 정주노동자들의 힘찬 연대와 지원이 절대 필요하다. 나아가 이주노동자들에 대한 차별,착취 구조는 HD현대중공업 한 사업장의 문제만은 아니다. 이번 공동행동투쟁을 기점으로 지역을 넘어 전국적 투쟁으로 확대 발전해 나가야 한다.

노동자혁명당(준)은 HD현대중공업 이주노동자들의 정당한 투쟁에 끝까지 연대할 것이며, 모든 이주노동자의 노동조합 조직화와 공동파업·공동투쟁의 확대를 위해 함께 싸울 것이다.
